Overview

This Web Hosting Agreement ("Agreement") is entered into by and between Bundle Group ("Provider") and the Client (collectively, the "Parties"). This Agreement defines the terms and conditions of web hosting services provided by Bundle Group.

Services Provided

Provider will supply the Client with web hosting services ("Services") on a shared hosting platform. Provider will allocate server resources as per the chosen service plan. The hosting service includes:

  • Domain setup and DNS configuration assistance
  • Ongoing server maintenance, monitoring, and security
  • Access to support via email and a ticketing system for technical issues
Term and Termination
Term:

This Agreement will commence upon the Client's payment and acceptance of the terms and will continue on a month-to-month basis unless terminated.

Termination by Client:

The Client may terminate this Agreement at any time by submitting a cancellation request through the Provider's support portal. No refunds will be issued for any remaining period after termination.

Termination by Provider:

Provider may terminate this Agreement at any time with written notice to the Client. In cases of violation of terms (e.g., prohibited activities, payment failure), Provider reserves the right to terminate Services immediately.

Client Responsibilities
Resource Management:

The Client is responsible for ensuring they stay within their allocated resources (e.g., storage, bandwidth). Resource overuse may result in service throttling or suspension.

Prohibited Activities:

The Client agrees not to engage in any prohibited activities on the hosting platform, including but not limited to:

  • Distributing illegal content or activities that violate local, state, or international laws
  • Engaging in abusive behavior, including harassment or hate speech
  • Running processes or applications that interfere with server stability or security
Data Backup:

While Provider performs regular backups, the Client is responsible for creating and maintaining backups of their website data. Provider is not liable for data loss under any circumstances.

Provider Responsibilities
  • Server Maintenance: Provider will ensure the hosting infrastructure is properly maintained, including updates, patches, and security monitoring.
  • Uptime Guarantee: Provider will work to maintain maximum service uptime as outlined in the SLA.
  • Security: Provider will take reasonable measures to protect server infrastructure from unauthorized access and DDoS attacks.
Client-Induced Data Breaches

The Client acknowledges and agrees that they are solely responsible for the security of their hosted website and any data processed or stored therein. The Provider shall not be liable for any data breaches, loss of data, or unauthorized access to the Client's hosting environment that arises from:

  • The Client's failure to maintain the confidentiality of their login credentials
  • The Client's negligence in securing their devices or accounts
  • The Client's failure to implement appropriate security measures
  • Any third-party applications or modifications introduced by the Client
Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Acceptance of Terms

By using Bundle Group's Services, the Client acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement.
